Our Work is Still Not Done!!!!


We have just received the response from our legal department at the AFGE National office in Washington, DC. Unfortunately after being reviewed by several attorneys they have indicated that they have not been able to devise a legal theory that would keep a suit over the DOD Authorization Act dual status program in court. This means that there will unfortunately be no National action by AFGE.

This further means that any actions will have to be done at the local level by individual local labor organizations, or district wide or by individuals themselves as they determine appropriate. 

Notwithstanding the legal review by AFGE , I have discussed this issue with AFGE National representative Gary Harding for District 2 and we both have agreed that we will carefully review each individual removal action within District 2 and depending on the merits of each individual case we will determine whether to selectively pursue this issue to seek third party resolution.
