Serving Civilian Technicians of the Guard and Reserve

Language: (c) UNREDUCED ANNUITY DEFINED-For purposes of this section, a technician shall be considered to be eligible for an unreduced annuity if the technician is eligible for an annuity under section 8336, 8412, or 8414 of title 5 that is not subject to a reduction by reason of the age or years of service of the technician.

Analysis: Unreduced annuities vary depending upon which retirement system the employee is counted under. For CSRS employees, this is 55 years of age and 30 years of service. Under FERS, there are several categories: 55-57 years of age (depending upon date of birth) and 30 years of service; 60 years of age and 20 years of service; and 62 years of age and 5 years of service that are considered as unreduced annuities.

Additionally because of the Early retirement provisions contained in NDAA 2000 a technician under FERS could also be eligible for an unreduced annuity as early as mid forties.
